Welcome to ‘Help Wanted,’ a collaborative multimedia project from WCNY and WMHT Educational Telecommunications. If you continue to browse and use these ‘Help Wanted’ web pages, you are agreeing to comply with and be bound by following terms of use, which together with our Privacy Policy govern WCNY and WMHT’s relationship to you in relation to the ‘Help Wanted’ Web site and/or blogs and other interactive features. The terms ‘Help Wanted,’ ‘Help Wanted Interactive,’ ‘us’ or ‘we’ refers to the owner of the Web site, whose registered offices are at WCNY, 506 Old Liverpool Road, Syracuse, NY 13220-2400 and at WMHT Educational Telecommunications, 4 Global View, Troy, NY 12180. The term ‘you’ or ‘user’ refers to the user or viewer of our Web sites.

The use of this Web site is subject to the following Terms of Use:

1. All information submitted by you is accurate and updated. In the case where registration or a user identity is required, you will not select or use an e-mail address or identity of another person with the intent to impersonate that person. You will not use an e-mail address to which another person has the rights without that person’s authorization. You will not impersonate any person or entity. Fraud committed will be subject to legal prosecution.
2. By using this site, you are certifying that you are at least 18 years. You also hereby certify that you are fully competent to enter into all obligations presented in these Terms and Conditions.
3. If you submit video content, images or textual content (‘User Submissions’ or ‘User Generated Content’), WCNY and WMHT do not guarantee any confidentiality with respect to any User Submissions. User Submissions are subject to review in the stations’ sole discretion and may not necessarily be published. WMHT and WCNY are not responsible for the quality or accuracy of content of User Submissions or User Generated Content, nor do we endorse or support any view, opinion, idea, suggestion, media or language presented therein.
4. You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with User Submissions, you affirm, represent, and/or warrant that: You own or have the necessary licenses, rights, consents, and permissions to use and authorize WMHT and WCNY to use all patent, trademark, trade secret, copyright or other personal and proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by ‘Help Wanted’ and these Terms. You further represent that all statements are accurate and factual in their content, and are not public statements of private information or defamatory in their nature.
5. You retain all of your ownership rights in your User Submissions. However, by submitting User Submissions to ‘Help Wanted,’ you hereby grant WMHT and WCNY a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display and perform the User Submissions in connection with ‘Help Wanted’ business, including without limitation for promoting and redistributing part or all of the ‘Help Wanted’ Web site or User Submissions (and derivative works thereof) in any media formats and through any media channels without a right of approval. You also hereby grant each user of ‘Help Wanted’ a non-exclusive license to access your User Submissions through us, and to use such User Submissions as permitted through the functionality of our Web site and under these Terms. The above licenses granted by you are perpetual and irrevocable.
6. In connection with User Submissions, you further agree that you will not submit material that is defamatory, copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from the rightful owner to post the material and grant WCNY and WMHT all of the license rights granted herein. In adhering to the Digital Millennium Copyright Act, if we are given proper notice of alleged infringement, we retain the right to remove or block the disputed content and to deny access to the site to users that repeatedly violate copyright or intellectual property rights or for any appropriate reason, and reserve the right to remove links to external web sites in our sole discretion.
7. We will make a good faith effort to protect intellectual property. If you believe that your copyrighted work has been reproduced without authorization (i.e., if you believe copyright infringement has taken place), you or someone acting on your behalf is hereby instructed to notify us using either of the following contact information:

1. Any content you submit must not produce SPAM, malware, chain letters, excessive mail or otherwise disrupt the normal flow of activity on the site.
2. You must not post anything that is deceptive or false.
3. You agree that you are not entitled to use ‘Help Wanted’ content for any purpose other than that for which the Help Wanted program was created.
4. WMHT, WCNY and our partners in the ‘Help Wanted’ project do not endorse any User Submission or any opinion, recommendation or advice expressed therein and, to the full extent permitted by law, expressly disclaim any and all liability in connection with User Submissions.
5. ‘Help Wanted’ is an online information exchange service for informational purposes only and does not constitute legal advice. The content of ‘Help Wanted’ Web pages is subject to change without notice. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this Web site for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
6. You shall not post, publish, transmit, reproduce, distribute or in any way use or exploit any information for commercial purposes or otherwise use the information in a manner that is inconsistent with these Terms and our Privacy Policy.
7. You are cautioned that any online communications may not be confidential. You agree that you have no expectation of privacy or confidentiality in the personal information you may intentionally or unintentionally disclose through login, information exchange and blog chat. Other than that which is necessary to enable your voluntary participation in the MySource StoryShare tool should you choose to contribute text, video or photos to that service, this site will not ask you for any personally identifying information. You should avoid saying or posting anything personally identifying in any format. You agree that Help Wanted Interactive has no liability for any violation of this Agreement by you or by any other user.
8. You agree not to use the site for distributing any software or hardware, or for using any information from ‘Help Wanted’ for unauthorized software or hardware.
9. WMHT and WCNY are not responsible for any computer virus or rogue programming that may be contained within the ‘Help Wanted’ site. WMHT and WCNY have no obligation to detect the presence of viruses or rogue programming. Any downloading of materials from this site is at your own risk. Further, your use of any information or materials from ‘Help Wanted’ is entirely at your own risk, for which we are not liable. You agree not to post, transmit or make available in any way any materials that contain a virus or rogue programming.
10. You agree not to hack or otherwise tamper with any code related to Help Wanted Interactive.
11. Reproduction of ‘Help Wanted’ design, layout, look, appearance, text, videos and graphics is prohibited.
12. Links to other Web sites are provided for your convenience and to provide further information. They do not signify that we endorse the Web site(s). We have no responsibility for the content of Web sites external to WCNY and WMHT.
13. Your use of ‘Help Wanted’ and any dispute arising out of such use is subject to the laws of the State of New York. You agree that any legal action related to Help Wanted Interactive will only be litigated in a court of competent jurisdiction located in the State of New York.
14. You agree not to post any abusive, obscene, vulgar, slanderous, hateful, threatening, harassing or sexually-oriented material—or any other material that may violate any laws in your country, state or under international law. In addition, you agree not to use posting capabilities for economic transactions of any kind. Be advised that any such material will not be posted by WCNY or WMHT in its sole discretion.
15. You hereby release and waive any and all claims and/or liability against ‘Help Wanted’ and its official partners in connection with your use of the ‘Help Wanted’ online elements and pages. You agree to defend, indemnify and hold harmless ‘Help Wanted’ from and against any and all claims of liability, including costs and attorneys fees, arising from or in connection with your use of ‘Help Wanted’ or failure to abide by applicable law.
16. If you find a violation of any of these terms or policies, you are instructed to contact us as identified in (7.) above.
17. You agree that, despite any law or statute to the contrary, except where prohibited by law, any claim or cause of action connected to your use of Help Wanted Interactive must be filed within one year after the claim or cause of action or else it will be considered null and void.
18. You understand and accept the fact that no warranty is available as to the quality, functionality, availability or performance of Help Wanted Interactive.
19. We reserve the right, at our discretion, to modify, add to or delete portions of these Terms at any time by posting updated Terms here. Please check these Terms frequently for updates. Any changes shall be effective immediately upon posting of updated Terms of Use. Your continued use after the posting of updated Terms of Use means that you agree to those changes.
